Judge Richard Bosson
Supreme Court of New Mexico
PO Box 858
Santa Fe, New Mexico
87504-4860

Dear Judge Bosson:

Purposes of this letter are to have you either take action or explain why you are not going to take action.

We paid $644 for two prima facie case 12 person jury trial lawsuits against former second judicial chief judge and convicted felon W John Brennan [http://www.prosefights.org/nmlegal/johnbrennan/johnbrennan.htm]and others for breach of contract which are guaranteed inviolate by New Mexico and federal constitutions.

See receipts for CV 0200107794 at http://www.prosefights.org/nmlegal/supremecourt/exhibitl.htm] and CV 0200203425 at http://www.prosefights.org/nmlegal/supremecourt/exhibitk.htm.

To date we haven't gotten what we paid for, trials by jury, which is guaranteed inviolate by New Mexico and federal constitutions.

We, so far, have been cheated out of our money and our civil rights by corrupt New Mexico federal and state judicial systems.

Judge Kenneth Brown and lawyer Jerry Walz dismissed CV 0200107794 in violation of New Mexico and federal constitutions. See http://www.prosefights.org/nmlegal/supremecourt/exhibito.htm.

Judge Robert Scott dismissed CV 0200203425 in violation of New Mexico and federal constitutions. See http://www.prosefights.org/nmlegal/supremecourt/exhibitp.htm.

As you may know from your legal education, only a plaintiff can move to dismiss when a lawsuit is properly pursued. See http://www.prosefights.org/nmlegal/jsccomplaintbrownscott/jsccomplaintbrownscott.htm#dismiss.

As you may also know from your legal education that citizens who pay filing fee for 12 person jury trial lawsuit are guaranteed right to trial by jury guaranteed inviolate by New Mexico and federal constitutions.

Your current mode of non-response to our official court request [see http://www.prosefights.org/nmlegal/roybalresponse2/roybalbossonnonresponse.htm#bossonresponse] is unacceptable and indicates that you are in intentional material violation of

Section 1. [Oath of officer.]

Every person elected or appointed to any office shall, before entering upon his duties, take and subscribe to an oath or affirmation that he will support the constitution of the United States and the constitution and laws of this state, and that he will faithfully and impartially discharge the duties of his office to the best of his ability.

It was your job under your oath of office as chief judge to New Mexico appeals court to see

1 that Brown's and Scott's unconstitutional judgments taking away Morales and Payne's tenth amendment civil right to represent themselves pro se in New Mexico state court were voided ab initio for reason that jury trial lawsuits cannot be dismissed except by plaintiff under New Mexico law and
2 that paid for twelve person jury trial prima facie case lawsuits CV 0200107794 and CV 0200203425against convicted felon former judge W John Brennan were brought before the chief judge of New Mexico supreme court for assignment to a judge for either settlement or prompt trial by jury as required by New Mexico rule judicial rule 1-088.

As you well know, you are personally been involved in the judicial misconduct aftermath of the dismissal of CV 0200107794 in violation of New Mexico and federal constitutions since 2002 when you were chief judge of New Mexico court of appeals. See http://www.prosefights.org/nmlegal/supremecourt/exhibito.htm.

You were personally involved in docketing the appeal of CV 0200107794 when convicted felon former judge W John Brennan sought to prevent appeal of CV 0200107794 which he was a defendant by preventing Payne from filing an appeal in second judicial district court. Read the details at http://www.prosefights.org/nmlegal/johnbrennan/johnbrennan.htm#gallegos.

Payne informed you of Brennan's attempt to inhibit filing an appeal in CV 0200107794 on June 7, 2002. Payne included $125 appeal filing fee.

Morales and Payne informed you of Brennan's attempt to inhibit filing an appeal in CV 0200203425 on August 6, 2002. Payne and Morales included $125 appeal filing fee.

Judge Alarid denied the appeal in CV 0200107794 the grounds that plaintiff Payne was untimely to file an appeal in district court. The point is that defendant judge W John Brennan along his lawyer Jerry Walz and judge Brown prevented Payne from filing a notice of appeal in second judicial district court!

Similarly W John Brennan, his lawyer Jerry Walz, and judge Scott prevent Morales and Payne from filing any and all pleadings to New Mexico courts in CV 0200203425.

So our only option left for us was to file directly to you judge Bosson.

All of the above prevention of appeals is documented. But the real point is that we were denied our right to paid for 12 person jury trial as guaranteed inviolate by New Mexico and federal constitutions.

So, judge Bosson, it appears you organized a fraudulent appeal in CV 0200203425 as evidenced by rulings by New Mexico appeals judges Alarid, Pickard, and Wechsler as evidenced by documents seen at http://www.prosefights.org/nmlegal/alaridpickardwechsler/alaridpickardwechsler.htm and a fraudulent appeal in Wechsler, Pickard, and Castillo CV 0200107794 as evidenced by documents seen at http://www.prosefights.org/nmlegal/wechslerpickardcastillo/wechslerpickardcastillo.htm.

The words fraudulent appeal are used because appeal of a an unlawful and unconstitutional action is unnecessary.

You, as a lawyer and judge, should have immediately voided ab initio crooked judges Brown and Scott's judgment then forwarded CV 0200107794 and CV 0200203425 to the chief judge of New Mexico supreme court for assignment of judge.

But you, instead, tried to get convicted felon judge W John Brennan out of two prima facie case 12 person jury trial lawsuits by orchestrating two fraudulent appeals.

Speculation as to why you violated your oath of office to "support the constitution of the United States and the constitution and laws of this state, and that he will faithfully and impartially discharge the duties of his office to the best of his ability" includes the possibility you apparently don't believe that right of trial by jury is inviolate and a New Mexico judge can dismiss a jury trial lawsuit.

Is this true?

We looked at your resume seen at http://www.prosefights.org/nmlegal//judicialraces2004/judicialraces2004.htm#bossoned.

Georgetown law school and the University of Virginia should have taught you the right to trial by jury inviolate.

We can only conclude that you deliberately violated your oath of office to assist convicted felon former judge W John Brennan evade justice.

You did this with help of New Mexico appellate judges Wechsler, Pickard, Alarid and even New Mexico supreme court judges Maes and Minzner.

You are quoted in the Albuquerque Journal, February 15, 2005,

Shortly after being named chief justice, Bosson said his top priority wourld "promoting the integrity of the judiciary."

with regard to Brennan's arrest for cocaine possession and DWI. See http://www.prosefights.org/nmlegal/fitch/fitch.htm#bossonlie.

Written evidence see in the links of the eletter supports the contention you are incapable of "promoting integrity of the judiciary" alone.

So we propose to help clean out crooked New Mexico judges and get our two paid for 12 person jury trial prima facie case lawsuits New Mexico CV 0200107794 and CV 0200203425.

Here's the course of action we propose to help solve some of the New Mexico judicial misconduct problems.

1 You must void judgments in CV 0200107794 and CV 0200203425.

2 You collect resignation letters from from your accomplices New Mexico appellate judges Wechsler, Pickard, Alarid and New Mexico supreme court judges Maes and Minzner for violating their oaths of office in New Mexico CV 0200107794 and CV 0200203425.

3 You then submit a letter to governor Richardson that these are the steps required for the process to establish the integrity, as you were quoted in the Albuquerque Journal.

If you cannot do this, then we suggest you the submit your own resignation letter to New Mexico supreme court to governor Richardson for violation of your oath of office for orchestrating fraudulently appeals in New Mexico CV 0200107794 and CV 0200203425.

One need only focus on receipts for CV 0200107794 seen at http://www.prosefights.org/nmlegal/supremecourt/exhibitl.htm] and CV 0200203425 seen at http://www.prosefights.org/nmlegal/supremecourt/exhibitk.htm to see that you were personally involved in depriving us of our right of 12 person trial by jury for prima facie case of breach of contract and harassment against felon former judge W John Brennan [see http://www.prosefights.org/nmlegal/johnbrennan/johnbrennan.htm] guaranteed inviolate by US and New Mexico state constitution.

You did not void unlawful judgments of Judge Kenneth Brown and lawyer Jerry Walz dismissing CV 0200107794 in violation of New Mexico state law 1-041. Dismissal of actions. [see http://www.prosefights.org/nmlegal/supremecourt/exhibito.htm] and Judge Robert Scott dismissing CV 0200203425 in violation of New Mexico 1-041. Dismissal of actions. [see http://www.prosefights.org/nmlegal/supremecourt/exhibitp.htm].

The above four documents should convince you, and certainly will convince others, that you have violated your oath of office in an attempt to help you colleague convicted felon former judge W John Brennan illegally evade justice in CV 0200107794 and CV 0200203425.

You thus established pattern and practice [pattern of conduct] of violation of your oath of office trying to protect convicted felon former judge W John Brennan.

4 If you cannot do what's right then, then we will have to ask that governor Richardson terminate then appoint replacements for these judges who will uphold their oath of office.

5 If you cannot do what's right then, we request that the new New Mexico supreme court chief judge immediately assign judge(s) to either see that New Mexico CV 0200107794 and CV 0200203425 are either settled or promptly go to trial by 12 person jury as we paid for.

We ask that you do 1 through 3 by April 26, 2005.

Sincerely

Arthur R. Morales
