We submitted the a FOIA request to DOE National Nuclear Security Administration on May 30, 2006.

Ms. Carolyn A. Becknell acknowledged its email receipt on June 12, 2006.


Federal Bureau of Investigation [FBI] and the National Security Agency [NSA] appear to violate the rules of both the Freedom of Information Act [FOIA] and Privacy Act [PA] by non-response in the original requests made by William Payne in 1996.

It was not until November 30, 2005 that Department of Justice [DOJ] FOI/PA lawyer James Kovakas procured requested documents from NSA.

The FBI is in a non-response mode to satisfy 1996 written request for 60 pages of responsive documents identified by Mr Kovakas.

It appears from written evidence at pro se fights that NSA, FBI, Sandia labs, and the Department of Energy [DOE] selects to avoid reasonable settlement through use of complacent, ignorant, arrogant, incompetent, criminal, malicious, poorly-educated, and lowly-unintelligent lawyers, and state and federal court judges.

We feel that the public should be made aware of DOE's abuse of taxpayer money used to defend its contractors caught in criminal activities.

To that end, we requested under the FOIA legal invoices for defending against our pro se and lawyer-paid lawsuit.

A similar FOIA revealed that Sandia Laboratories and DOE had spent over $1,000,000 in lawyer fees just to 1996. We did not get started in our joint legal projects until February 28, 1997 so we expect the amount of taxpayer money squandered on lawyers to be many times the over $1,000,000 in the years between 1996 and 2006.

Sandia Labs, NSA, FBI and DOE have used the strategy of a fourteen [14] year delay to avoid settlement.

We do not wish to continue the strategy of delay, so we feel we must hold National Nuclear Security Administration [NNSA] Service Center to strict FOIA time guideline which permit us judging our request denied if the requested documents are not given to us by the end of the the time guideline.

At this time we will file an appeal to DOE which must be answered within a specified time. If the appeal is denied or not responded to, then we are free to file a complaint, in the case, in the District of Columbia to get the lawyer invoices.

But there is a problem with an appeal to DOE. You, DIRECTOR, HEARINGS & APPEALS, were defendant, along with former Energy Secretary, and now governor of New Mexico, Bill Richardson in Payne v. EEOC et al. Case Number: 99cv00270.


Taxpayer money was used to try to protect you and Richardson.

1 We ask that you inform us by email how our appeal of Service Center Control Number FOIA 06-093-C will be processed by July 10, 2006.

Any additional FOIA or PA lawsuits related to Sandia Lab's non-energy NSA and FBI work, we feel would not be in the public interest because of further legal expenses.

We feel that prompt settlement of these unfortunate matters is both in the public and NSA's, FBI's, DOE's and Sandia labs interest.

So we enlist your help to see that these unfortunate matters are promptly settled before they get far worse.

We realize that lawyers like to feel that they are in control and try only to deal with other people through their lawyers.

As a result of our discovery and documentation of lawyer misbehavior as well as 14 years of legal experience we will not employ lawyers in a settlement phase.

Our team will negotiate settlement.

We ask that you help NSA, FBI, DOE and Sandia Labs settlement negotiators to contact us directly.

2 We ask that you respond to us by email about settlement also by July 14, 2006.

Final. Morales had several changes which included adding the words malicious and criminal.

3  Take action against complainer.
4  Attempt to discredit complainer. Ruin complainer's reputation and career.
5  Attempt to drive complainer to suicide, divorce, alcohol or drug abuse.
6  Financially ruin the complainer through delay another legal tactics.
7  Enlist help of state delegation to destroy the complainer.
8  Improperly influence complainer's lawyer. *
9  Improperly influence judge. *
10  Load the jury. *
11  Hide behind classification.
12  Seal the case to protect the government.

We've been at the DC court before in 1996.

We must reason, be conciliatory, and suggest that George Breznay help with settlement before things get far worse.

Payne is out well over $1,000,000 as a result of criminal actions taken against him by Sandia labs, DOE, FBI, [NSA? DOJ lawyer Kovakas wanted Payne to know that it was the FBI, not directly NSA, by not redacting special agent].

Morales is also out lots of money from retaliation actions taken by Sandia labs against him for his an Manuel Garcia's successful racial discrimination class actions lawsuit.

Lawyers proved ineffective in getting our money.

Payne came up with the idea to get all of his personal information by using the Freedom of Information Act [FOIA] and the Privacy Act [PA] in order to get the evidence to prove his innocence.

Payne asked Morales to join him in the NSA lawsuit.

But Morales was hesitant at first but felt it was worth the effort to see if our rights to obtain copies of our personal would be possible.

As it can be seen, it has taken about ten (10) years for NSA documents to reach Payne. The FBI still has not responsed.

DOJ lawyer Jim Kovakas finally sent the NSA documents on November 30, 2005 and acknowledged the 60 pages of FBI documents which led us through a court battle of many lawsuits and interactions with many people in high places.

These people have refused to reason or help us settle these matters either through their complete disregard or through their arrogance or ignorance. Every step of this legal trek has been memorialized on this website of all the events and supporting documents.

Our legal project is proceeding as planned. We will continue to do what we need to do to get matters settled.
