Not a good idea for lots of reasons in this Internet age.

In my situation I have observed the the FBI appears to try to protect the government as opposed to protect me from government wrongdoing.

I would like to see the FBI do its job and investigate the complaint sent to Carter, Colonel Feehan, Colonel Taylor, General Gabreski, magistrate judges Lorenzo F Garia, judge M Christina Armijo and issue a finding of fact.

Brzezinski may have committed a serious crime which may jeopardize safety of Americans.

In addition to genocide, there possibly was insider trading in oil in 1980.

We realize that the statute of limitations on insider trading is five years. But we think the public should know who was involved.

There apparently is no statute of limitations on a genocide criminal complaint affidavit.
(e) Nonapplicability of Certain Limitations.— Notwithstanding section 3282 of this title, in the case of an offense under subsection (a)(1), an indictment may be found, or information instituted, at any time without limitation.

You wrote in your December 10, 2007 email "[relatively routine request of NSA sent to NSA under my name ..."



While this apparent request may have been relatively routine, it and other related events have cost me several millions of dollars.

I would like to obtain copies of the documents sent to NSA which, I believe, have been improperly withheld from me.

US DOJ OIP Associate Director Janice McLeod rejected my appeal on April 22, 2008.

Ms McLeod said she would phone me on Thursday May 15, 2008 with regards to a question I had about the April 22, 2008 appeal rejection letter.

Ms McLeod has not phoned.

My impression is Ms McLeod intends to do nothing which is supported by the last sentence in her letter.
If you are dissatisfied with my action on your appeal, you may file a lawsuit in accordance with 5 U.S.C. § 552(a)(4)(B).

Another lawsuit may be unnecessary to resolve these unfortunate matters.

CV 2000-10278 was fraudulently removed to federal court and given case number 00cv01677.

Any judgment rendered by a court which lacks jurisdiction, either of the subject matter of the parties, or lacks inherent power to enter the particular judgment, or entered an Order which violated due process or was procured through extrinsic or collateral fraud, is null and void, and can be attacked at any time, in any court, either directly or collaterally, provided that the party is properly before the court.

So it would probably be more expedient to file to void judgments in 00cv01677 rather than file a new FOIA/PA lawsuit in the District of Columbia?

Ultimate goal is to get these unfortunate matters peacefully settled as soon as possible.

Your help in reasoning with the FBI of possible consequences of inaction would also be appreciated.

I would like to have your response by May 29, 2008.

Non-response means I must take additional legal action.

Almost all of Iran's huge oil reserves are located in giant onshore fields in Khuzestan, near the Iraqi border and Persian Gulf. Two years ago, the giant onshore Azadegan Field was discovered - one of the largest found in over 30 years - only a few miles from the Iraqi border in Khuzestan. The salesman, Hans Buehler, was on his 25th trip to Iran on behalf of Crypto when Iranian intelligence agents grabbed him, accused him of spying for the United States and Germany, held him in solitary confinement and interrogated him.

"I was questioned for five hours a day for nine months," Mr. Buehler says. "I was never beaten, but I was strapped to wooden benches and told I would be beaten. I was told Crypto was a spy center."

After nine months,Crypto paid $1 million to win Mr. Buehler's freedom. But a few weeks after Mr. Buehler's triumphant return to Switzerland, Crypto abruptly dismissed him and demanded that he repay the $1 million.

Mr. Buehler was baffled and bitter, he says. In 13 years with the company, he had no inkling that it had cooperated with foreign spies and assumed the Iranians' charges were groundless. But what he learned after he was fired persuaded him otherwise.

Bill - This appears to be a relatively routine request of NSA sent to NSA under my name but, as indicated by the initials preceeding my typed name, it was signed out by a subordinate supervisor in the Internal Security Section of my Division who had authority to intial off on this type of document. This would be indicated by placing my initials (WG) slash and then his initials. His name would have been at the red dot and was properly redacted from the memo. This is just one of hundreds if not thousands of memos sent interagency under my name during my two years as Assistant Director, Intelligence Division. I personally have no knowledge of this case and it would not have been staffed up to my level based on the information in this declassified memo. Any additional action called for would have depended upon NSA's review results. Sorry I couldn't have been of more assistance.

$384,000 Sought From Ex-LANL Worker

SANTA FE - Jessica Quintana's attempt to catch up on work at Los Alamos National Laboratory last year could cost her $384,000 if the Department of Energy has its way.

The Energy Department wants the former Los Alamos contract worker to pay restitution for downloading and printing classified information that she took home with her, attorney Stephen Aarons said in recently filed court documents.

Quintana in July pleaded guilty to a misdemeanor charge of mishandling classified material and is scheduled to be sentenced Thursday in federal court in Albuquerque.

In a pre-sentencing memo filed Dec. 14; Aarons says it would be unjustified for Quintana to have to pay for the copied documents that are of "negligible replacement value."

Numerous other government officials have mishandled classified information and earned little more than a slap on the wrist, the memo states.

In one case, classified material was discovered in the trunk of a car belonging to a former ambassador to the Soviet Union following a traffic accident, according to the memo. The ambassador was reprimanded and continued in the Foreign Service, the memo states.

And more recently, Samuel Berger, the national security adviser in the Clinton White House, was fined $10,000 after he took classified documents out of the National Archives.

The memo also mentions the members of Los Alamos' corporate management team who in January e-mailed classified nuclear weapons information over unsecured channels.

"Not surprisingly, there were no disciplinary steps taken against the senior executives, let alone a criminal prosecution as seen in the present case," the memo states.

The memo continues: "It seems ironic that the Laboratory would request restitution in this case when the employee happens to have been a college student earning 14 credits at the University of New Mexico while working part time at Los Alamos to help pay for her tuition.

"As the probation office already noted, she is hardly in a position to pay sums to the Department of Energy even if the court considered it just to do in this instance."

Quintana also faces up to a year in prison and a $100,000 fine, although prosecutors have not opposed her request for probation.

The memo states that neither Quintana's probation officer nor the U.S. Attorney General's Office is urging restitution as appropriate in the case.

John Broehm, a spokesman with DOE's National Nuclear Security Administration, said he could not comment on the matter because it remains an ongoing legal proceeding.

The Energy Department has already fined the lab's corporate manager, Los Alamos National Security, $300,000 for the security breakdown, while the lab's former manager, the University of California, recently agreed to pay a $2.8 million fine.

The discovery of the classified material - found during an October 2006 drug bust focused on Quintana's roommate - triggered fresh scrutiny of Los Alamos, which has been besieged with high-profile security problems in recent years.

In his memo, Aarons states that Quintana's negligence brought to light the Energy Department's shortcomings. "Though Ms. Quintana was criminally negligent, her negligence was in large measure only a symptom of systemic problems at the Laboratory and environmental forces beyond her control," Aarons states.

Aarons writes:

1 Whether by inadvertence, the press of federal caseloads, or design, the court suggested at a pretrial conference in May 1993, that both parties suspend further discovery until it ruled on defendants' summary judgment motion. Discovery has ceased ever since.

2 Nearly one year ago, on August 19, 1993, the court issued its amended protective order, effectively sealing all substantive pleadings in this case.

3 Before issuing that order, the court considered plaintiff's written response against sealing. Judge Conway informed all counsel in open court that James R. Gosler would be permitted to deliver unknown documents to Judge Conway at time and place certain.

4 Judge Conway apparently reviewed those documents in camera without counsel for plaintiff.

5 The communication with Gosler constitutes an improper, ex parte communication with the one defendant who has been charged in plaintiff's amended complaint with the most outrageous and culpable acts.

6 Given the nature of this lawsuit, where defendants allege some sort of security infraction by plaintiff as justification for his firing, such communication under the guise of national security violated plaintiff's due process rights. Plaintiff has been prejudiced by this improper communication coupled with protracted delays. ...

WHEREFORE Plaintiff William H. Payne requests that:

A Judge Conway recuse himself from further participation in these proceeding, based on improper communication with defendant Gosler,

B The newly designated judge reconsider the standing protective order without recourse to ex parte communications with a named defendant, or in the alternative, allow counsel for plaintiff to review and respond to such communications, and,

C  The court deny defendants' long-standing motion for summary judgment, set new discovery deadlines under the circumstances, and grant such further relief as justice requires.

Monday July 30, 2007 I received my FOIA/PA request dated July 14, 2007 returned along with a form letter signed by David Hardy.


I returned a similar form dated October 23, 2006. Please refer to my October 31, 2006 letter to Mr Hardy.

First paragraph stated
Your request was forwarded to FBI Headquarters from the Albuquerque Field Office. Your letter did not contain sufficient information to conduct an accurate search of the central records system at FBI Headquarters.

We believe that the records were accurately described. Look at affidavit by James Gosler filed 12/31/1992 gave to judge John Conway.


Speculation is that Gosler's affidavit was given to then Albuquerque Special Agent In Charge Matt Perez who then forwarded it to Wayne R Gilbert.

One reason for this speculation is that Matt Perez told my friend Mr Arthur Morales, Morales reported again on Tuesday July 31, 2007, to stay away from since I knew too much and could be very dangerous.


So your statement about the documents not being identifiable appears to be false.

It appears that the FBI and New Mexico judge John Conway were deceived by James Gosler but that neither Conway or the local FBI office employees realized this at the time.

Later, however, Mr Gilbert appears to have uncovered the hoax.


Please send easily identifiable documents within 10 working days to help get these unfortunate matters settled before they become far worse.

I omitted to state a start and end date in my July 14, 2007 Freedom of Information Act [FOIA] and Privacy Act [PA] request.

I tried to phone you [Call to FBI special-agent-in-charge McClenaghan] but you did not return my call.

So start date of my FOIA/PA request in January 1, 1992 and stop date is July 24, 2007.

We feel that release of these documents is likely to help settle these unfortunate matters which have now escalated to Title 18 felony criminal complaints filed with KAFB commanded Col Feehan.

Dear Mr McClenaghan:

This is a request made under the Freedom of Information Act [FOIA] and Privacy Act [PA].

Sandia supervisor James Gosler apparently turned me in to the Albuquerque Office of the FBI in 1992 with the apparent charge of committing some type of national security crime.

I deny committing any crime.

The FBI declassified a Wayne R Gilbert a letter on December 8, 2006 acknowledging existence on documents containing my name [William H Payne, Payne, Bill Payne, etc] forwarded from your office to the FBI which then forwarded to the National Security Agency [NSA]. And presumably materials were sent back from NSA to the FBI in WDC and back to you office.

I request copies of all of these documents. If any are classified, then I ask that you identify these documents so that I can request a mandatory declassification review.
