Bosson Will Work of Securing Resourced, Promoting Integrity

But Bosson said he has an even more important goal.

"... The No. 1 thing for me is promoting the integrity of the judiciary," he said Monday during an interview. "We took some shots last year, some of them right to the solar plexus."

The main one was the May 29 arrest of Bernalillo County Chief Judge W. John Brennan on drunken driving and drug possession charges. The incident sent shock waves through the judiciary and gave ammunition to court critics.

"We've largely recovered over time, but that was a lesson that you have to be ever-vigilant in promoting the importance of being one step above what everyone else's conduct is," Bosson said.

The public needs to be reminded that judges are human, but when they fail, there will be consequences, he said.

At the end of his two years as chief justice - the position, by custom, rotates - Bosson says he hopes confidence will be restored and the level of civil and political discourse about the judiciary will be improved.

Bosson's proposals involve helping to steer money to court-related agencies that aren't under the court's dominion, including the Judicial Standards Commission and the New Mexico Public Defender Office.

"The public defender is chronically underfunded. and understaffed," he said.

He will encourage legislators to double the budget of Judicial Standards and to beef up the budget for prosecutors as well. He will ask for 50 new employee slots statewide for the courts alone. District attorneys are a separate entity, and public defenders are included in the executive budget.

That request is a third of the 152-position need identified by the court's internal budget process. It includes six judgeships, two of them - one metro and one district judge - in Albuquerque. The other slots would go to the 9th (Clovis/Portales) and 11th judicial districts (Farmington/Gallup) for district judges and for magistrates in Santa Fe and Farmington.

Bosson will ask for money to expand drug courts to parts of the state that dot have them and want them, or to replace federal funds that have expired.

He says he will promote a proposal for an independent analysis of staff needs of the courts, district attorney offices and public defenders statewide. Such a study, he said, could help avoid the squabbles about who needs bodies more.

Bosson likes the metaphor of justice as a three legged stool that functions poorly, if it all, when one of its lees is gimpy.

And to underscore the point, he has only to dig out statistics of the number of cases postponed because a defender or prosecutor wasn't ready - a dilemma that continues up through the appellate level.

"Every single week," Bosson said, "this court grants extensions by the dozens in criminal prosecutions of the six-month rule. I was shocked when I first got to this court. I had a stack (of requests) 12 inches high. Most of the time you grant the extension because there are reasons. And the overriding reason is the public defender delays due understaffing and. overdemand."

Skimping on staff short term can mean cases may have to be retried, thereby costing more in the long term, he said.

Although the situation has improved a little, he said it's still not uncommon to grant six or seven extensions.

"Everybody suffers, not least of all the victim," Bosson said. "My role is to focus attention on the problem ... I don't want to be hysterical,, but we're in serious jeopardy."

Richard Bosson did file Payne's appeal with New Mexico appellate court despite convicted felon judge W John Brennan not allowing him to file an appeal in district court. Brennan, of course, was a defendant.

Let's hope Bosson sees the merit of appointing a judge to either settle or have our two prima facie case breach of contract lawsuits against Brennan.

We don't plan to kiss our money away when the product is guaranteed inviolate by both New Mexico and Federal constitutions ... without a good fight, of course.

Chief Justice:Legal System in Trouble

Criminal defense attorneys in New Mexico, including Mark Donatelli and Gail Evans, legal director of the New Mexico Center on Law and Poverty, have called the recent legislative session a failure for the state Public Defender Department when it failed to get money to hire new lawyers to relieve high caseloads.

Bosson on Tuesday said the current situation is one where the public defender has to "compete with a hundred other agencies and has to settle for crumbs."

Bosson cited a recent advertisement in the New Mexico Bar Bulletin seeking attorneys who are willing to work for free to help solve a backlog of cases in the Appellate Division of the Public Defender Department as evidence of the staffing problems there.

"The fact that we have to go out with a tin cup, so to speak, begging for help - New Mexico hasn't had to do that in decades," Bosson said.

Bosson said in a Tuesday news release that he has asked the task force chaired by Bigelow "to develop recommendations to save the state's indigent criminal defense from collapsing."

"From everything we know so far, our criminal justice system is understaffed and underfunded, particularly in regard to the public defender," Bosson said in the release. "I want the Task Force to either confirm or refute this, and then tell us more, including what the right workloads are for defense lawyers."

Bigelow said Tuesday that as task force chair- man, he will get the group to do the work Bosson has directed it to do as fast as it can.

Bosson also suggested that the task force might look at whether the Public Defender Department should be independent of the executive branch. Currently, the chief public defender in New Mexico is appointed by the governor.

Judge Alarid denied the appeal in CV 0200107794 the grounds that plaintiff Payne was untimely to file an appeal in district court. The point is that defendant judge W John Brennan along his lawyer Jerry Walz and judge Brown prevented Payne from filing a notice of appeal in second judicial district court!

Similarly W John Brennan, his lawyer Jerry Walz, and judge Scott prevent Morales and Payne from filing any and all pleadings to New Mexico courts in CV 0200203425.

So our only option left for us was to file directly to you judge Bosson.

All of the above prevention of appeals is documented. But the real point is that we were denied our right to paid for 12 person jury trial as guaranteed inviolate by New Mexico and federal constitutions.

So, judge Bosson, it appears you organized a fraudulent appeal in CV 0200203425 as evidenced by rulings by New Mexico appeals judges Alarid, Pickard, and Wechsler as evidenced by documents seen at http://7cities.net/users/billp/alaridpickardwechsler/alaridpickargwechsler.htm and a fraudulent appeal in Wechsler, Pickard, and Castillo CV 0200107794 as evidenced by documents seen at http://7cities.net/users/billp/wechslerpickardcastillo/wechslerpickardcastillo.htm.

The words fraudulent appeal are used because appeal of a an unlawful and unconstitutional action is unnecessary.

You, as a lawyer and judge, should have immediately voided ab initio crooked judges Brown and Scott's judgment then forwarded CV 0200107794 and CV 0200203425 to the chief judge of New Mexico supreme court for assignment of judge.

But you, instead, tried to get convicted felon judge W John Brennan out of two prima facie case 12 person jury trial lawsuits by orchestrating two fraudulent appeals.

Speculation as to why you violated your oath of office to "support the constitution of the United States and the constitution and laws of this state, and that he will faithfully and impartially discharge the duties of his office to the best of his ability" includes the possibility you apparently don't believe that right of trial by jury is inviolate and a New Mexico judge can dismiss a jury trial lawsuit.

3 You then submit a letter to governor Richardson that these are the steps required for the process to establish the integrity, as you were quoted in the Albuquerque Journal.

If you cannot do this, then we suggest you the submit your own resignation letter to New Mexico supreme court to governor Richardson for violation of your oath of office for orchestrating fraudulently appeals in New Mexico CV 0200107794 and CV 0200203425.
