NSA got caught

In the end, neither Iran nor Iraq would win a clear victory, but the suffering was enormous on both sides. Conservative estimates place the death toll at 367,000-262,000 Iranians and 105,000 Iraqis. An estimated 700,000 were injured or wounded on both sides, bringing the total casualty figure to over one million. 43

Dear NSA/CSS FOIA Appeal Authority:

Louis F Giles wrote in his 23 September 2005 FOIA appeal letter seen at http://www.prosefights.org/nmlegal/nsa/nsa10232005/nsa.htm

Any person denied access to information may file an appeal to the NSA/CSS Freedom of Information Act Appeal Authority. The appeal must be postmarked no later than 60 calendar days after the date of the denial letter.

Purpose of this letter is to file an appeal to Giles letter postmarked September 28, 2005, Fort George G Meade, MD.

Mr Giles wrote

Some of the information withheld was found to be currently and properly classified in accordance with Executive Order 12958, as amended. This information meets the criteria for classification as set forth in Subparagraph (c) of Section 1.4 and remains classffied SECRET as provided in Section 1.2 of the Executive Order. The information is classified because its disclosure could reasonably be expected to cause serious damage to the national security.

I believe that the withheld material is improperly classified.

Executive Order 12958 seen at http://www.fas.org/sgp/clinton/eo12958.html allows evaluation that "information is classified in violation of this order" under Sec. 3.2(c)

Therefore I request a proper classification review by the Director of the Information Security Oversight Office.

In event that Director of the Information Security Oversight agrees with my contention, then I ask that NSA send the currently withheld documents to me.

I ask that NSA respond to this appeal within the promised 20 days.
