Dear Mr Roybal:

We did not receive a response to our November 30, 2004 letter from you.

Instead we received the unsolicited CONFIDENTIAL letter from James C Noel, Executive Director and General Council of the New Meixco Judicial Standards Commission seen at http://www.prosefights.org/nmlegal/noelletter12032004/noelletter.htm.

At issue is exactly how we are going to either settle or have paid for trial by 12 person juries for prima facie cases New Mexico lawsuits CV 0200107794 [see receipt at http://www.prosefights.org/nmlegal/supremecourt/exhibitl.htm] and CV 0200203425 [see receipt at http://www.prosefights.org/nmlegal/supremecourt/exhibitk.htm] for breach of contract against former second judicial chief judge and convicted felon W John Brennan [http://www.prosefights.org/nmlegal//johnbrennan/johnbrennan.htm]?

Since Noel's unsolicited CONFIDENTIAL December 3, 2004 letter does not answer the questions directed to you in our November 30, 2004 letter we don't understand what Noel's letter is an attempting to do. Is the letter an attempt to intimate us by threat of contempt by the New Mexico supreme court and tell us that we are not going to get settlement or our two jury trial lawsuits guaranteed inviolate by New Mexico and federal constitutions?

The reason New Mexico lawsuits CV 0200107794 and CV 0200203425 must either be settled or must go to trial as each will guarantee our rights in pursuit of justice but also the opportunity to prevent significant losses to plaintiffs.

New Mexico lawsuit CV 0200203425 involves compensation for not having paid for 12 jury trial lawsuit [breach of contract] for replevin for taking our money without due process. All evidence of guilt is in writing seen at http://www.prosefights.org/nmlegal/supremecourt/svet1.htm and http://www.prosefights.org/nmlegal/supremecourt/svet2.htm. Damages are estimated to be on the order of several hundred thousand dollar measured over about 13 years.

New Mexico lawsuit CV 0200107794 involves compensation for not having paid for 12 jury trial lawsuit [breach of contract] for defamation [libel] for unauthorized distribution of false and defaming documents see at http://www.prosefights.org/nmlegal/supremecourt/cvpa.htm. Actual loss of salary is over $1,000,000.

While we hoped that the Judicial Standards Commission would have taken appropriate steps to investigate and address our complaint why judges Brown and Scott unlawfully dismissed New Mexico lawsuits CV 0200107794 and CV 0200203425, the Judicial Standards Commission did not address our complaint.

We can only conclude that Judicial Standards Commission's chair David S. Smoak's October 25, 2004 letter [see http://www.prosefights.org/nmlegal/jscsettlement/jscsettlement.htm#redact] is going to do nothing about crooked judge Kenneth Brown improperly dismissing 12 person jury trial CV 0200107794 and crooked judge Robert H Scott improperly dismissing CV 0200203425 in violation of New Mexico court rules which is supported by written evidence in our complaint accompanying letter seen at http://www.prosefights.org/nmlegal/jsccomplaintbrownscott/jsccomplaintbrownscott.htm.

Failure of the Judicial Standards Commission to address judges Brown and Scott dismissing, in violation of New Mexico court rules, our two paid for prima facie case lawsuits compelled us to file writ to void judgments ab initio. Recently appointed New Mexico supreme court judge Richard Bosson is quoted in the Albuquerque journal on January 18, 2005 saying

"... The No. 1 thing for me is promoting the integrity of the judiciary,"

So to help promote integrity in the New Mexico legal system, we are sending a copy this letter to judge Bosson with the request that he assign a judge in a district other than 2 and 13 to have New Mexico lawsuits CV 0200107794 and CV 0200203425 either settled or promptly heard by juries of 12 persons as required by New Mexico state law and constitution.

We ask that Mr Noel please write us to explain if his unsolicited CONFIDENTIAL December 3, 2004 letter seen at http://www.prosefights.org/nmlegal/noelletter12032004/noelletter.htm is not a threat letter.

If we don't hear from Mr Noel by close of business on February 11, 2005, then we must assume that Noel and you conspired to deprive us of our right to paid for 12 person jury trial lawsuits guaranteed inviolate by New Mexico and US constitutions. We will then take appropriate action.

We ask that judge Bosson also respond by February 11, 2005.

We are also forwarding an ecopy to the Albuquerque city counsel in the hope they can help reason with the Judicial Standards Commission on the importance of cleaning up or out the New Mexico corrupt judicial system.
